Terms of Service

This Terms of Service Agreement (“Agreement”) outlines the terms and conditions for the use of photos provided by Certified Handling Systems ("CHS") to its clients (“Client”). By using, distributing, or reproducing the photos provided by CHS, the Client agrees to the following terms:

1. License and Usage Rights
CHS grants the Client a non-exclusive, non-transferable license to use the provided photos solely for internal use, marketing, or project documentation purposes.
The photos may not be altered, resold, or redistributed to third parties without prior written consent from CHS.
2. Ownership and Copyright
All photos provided remain the exclusive property of CHS and are protected under applicable copyright laws.
CHS retains the right to use these photos for its own marketing, promotional, and business purposes, including on websites and social media platforms.
3. Client Responsibilities
The Client agrees to use the photos in a lawful manner that does not misrepresent or defame CHS or any other party.
Proper credit to Certified Handling Systems is required where applicable, especially for public marketing purposes (e.g., social media posts or press releases).
4. Liability and Indemnity
CHS is not liable for any misuse or unauthorized distribution of the provided photos by the Client.
The Client agrees to indemnify and hold CHS harmless from any claims or damages resulting from the unauthorized or improper use of the photos.
5. Termination and Revocation
CHS reserves the right to revoke the Client’s license to use the photos at any time if the terms of this Agreement are violated.
Upon termination of this Agreement, the Client agrees to immediately cease the use of the photos and delete any stored copies.
6. Disputes and Governing Law
Any disputes arising from this Agreement will be governed by the laws of the state of Utah, without regard to its conflict of law principles.
7. Acknowledgment
By accepting and using the photos provided by Certified Handling Systems, the Client acknowledges that they have read, understood, and agreed to the terms outlined in this Agreement.
